Recent Judgment – Waiver of Mandatory Waiting Period in Divorce

In a landmark ruling, the Madras High Court recently held that Family Courts are entitled to waive the mandatory waiting period under Section 10A of the Indian Divorce Act in mutual consent divorce cases. This development significantly impacts couples seeking quick and amicable resolutions.

The Court observed that compelling parties who have mutually agreed to divorce to wait for the cooling-off period only increases their emotional distress. The judgment was delivered in the case of Shivkarthik G.S vs. Nil Parties, where the petitioners had mutually agreed to separate but were caught in a procedural delay due to the mandatory waiting period.

Justice P.B. Balaji, while considering the revision petition, pointed out that the petitioners had affirmed their decision to part ways voluntarily and without any fraud, collusion, or undue influence. The judge emphasized that the relationship had become "irreconcilable and distressing" and that delaying the divorce would only cause more agony.

Key Observations by the Court:

The petitioners were not blessed with children, and thus, the matter did not involve child custody.

Both parties voluntarily agreed to divorce and expressed their wish to move forward without delay.

Given the circumstances, the Court ruled that Family Courts have the discretion to waive the cooling-off period and expedite the divorce proceedings.

While the judgment of the Kerala High Court in a similar case does not have binding precedent, the Madras High Court considered its persuasive value, along with the Supreme Court’s ruling in Shilpa Sailesh’s case, to strike down the mandatory waiting period in mutual consent divorce cases. The petition was allowed, and the couple was granted permission to proceed with their mutual consent divorce.
