Supreme Court Quashes FIR Against In-Laws in Matrimonial Dispute

Supreme Court Quashes FIR Against In-Laws in Matrimonial Dispute | Advocate Devashish Maharishi – Best Divorce case Lawyer in Karkardooma Court, Delhi

In a significant ruling, the Supreme Court of India has quashed criminal proceedings against the father-in-law, mother-in-law, and sister-in-law of a complainant in a high-profile matrimonial dispute, citing vague and unsubstantiated allegations that failed to establish a prima facie case under Sections 498-A, 377, and 506 read with Section 34 of the Indian Penal Code (IPC).

Key Highlights of the Judgment:
Case Title: Sanjay D. Jain & Ors. Vs. State of Maharashtra & Ors.

Case No: Special Leave Petition (Crl.) No.12584 of 2024

Coram: CJI B.R. Gavai, Justice K. Vinod Chandran, and Justice Atul S. Chandurkar

Background:
The dispute arose from a marriage solemnized in July 2021, where the complainant alleged dowry demands and unnatural sexual acts by her husband. An FIR was filed in February 2022, including Sections 498-A, 377, and 506 IPC. However, the Supreme Court noted that while certain allegations may be directed at the husband, the FIR did not disclose specific or detailed accusations against the in-laws.

Supreme Court Observation:
The Court observed:

“All other statements are of a general nature as well as vague without any particulars... continuing the proceedings against the in-laws would constitute an abuse of the process of law.”

The Apex Court referred to the precedent set in State of Haryana v. Bhajan Lal, reiterating that FIRs must disclose prima facie offences to warrant criminal proceedings. As a result, the FIR was quashed against the complainant’s in-laws.
