The Hon'ble Justices Anil Kshetarpal and Harish Vaidyanathan Shankar emphasized that:

“Mental cruelty is a state of mind... a sustained course of abusive and humiliating treatment calculated to torture, discommode or render miserable the life of the spouse.”
Drawing from key judgments like Samar Ghosh v. Jaya Ghosh, V. Bhagat v. D. Bhagat, and Parveen Mehta v. Inderjit Mehta, the Court observed that the wife's repeated acts — including false accusations, physical assault, and misuse of legal provisions — amounted to grave cruelty, making cohabitation impossible.

In particular, the April 2013 incident, where the wife allegedly assaulted her husband at his clinic causing injury and damage, was considered a serious act of physical cruelty, unacceptable in any matrimonial relationship. 

Furthermore, the Court clarified that:

Filing unsubstantiated complaints and launching vexatious litigation does not count as “protecting matrimonial rights.”

Even though irretrievable breakdown of marriage is not a statutory ground under the HMA, the decade-long separation and failed reconciliation attempts strengthened the case for cruelty.

The husband's consistent evidence and emotional trauma justified the grant of divorce, and the Family Court’s decree was rightly upheld.
