  • The concept of Hizanat (custody under Muslim Personal Law) cannot override Articles 14 and 15 of the Indian Constitution, which guarantee gender equality and non-discrimination.

  • The mother’s modest means did not render her unfit as a custodian.

  • Courts must apply constitutional principles, not just personal laws or foreign court orders, when deciding custody.


👩‍👧‍👦 Mother’s Right to Custody Reaffirmed

Rejecting the argument that the father automatically gains custody after a certain age due to Hizanat, the Court declared:

“Such a view is inconsistent with the constitutional guarantees under Articles 14 and 15… Custody jurisprudence is not to be confined to statutory enactments but also extends to constitutional principles.”

Ultimately, the High Court allowed the appealset aside the lower court’s order, and upheld the mother’s custody of the children.
