🧾 Maintenance Claim Against Minor Husband Allowed

Case Title: Abhishek Singh Yadav vs State of UP & Others

Court: Allahabad High Court
Order Date: 25 September 2025
Bench: Hon’ble Justice Madan Pal Singh

🧑‍⚖️ Judgment Summary:

In a significant interpretation of Section 125 CrPC, the Allahabad High Court ruled that:

  • A maintenance application can be filed against a minor husband, even though he is not legally competent to support his family at the time of filing.

  • In this case, a 13-year-old boy was married and had a child. When he turned 16, his wife filed an application under Section 125 CrPC, seeking maintenance for herself and the child.

  • The Family Court awarded ₹5,000/month to the wife and ₹4,000/month for the child.

  • The husband, now nearing 18, challenged the order, arguing that:

    • He was a minor, hence not liable.

    • His wife had refused to live with him without valid cause.

🏛️ High Court’s Observations:

  • The Court clarified that Section 125 CrPC has no bar on proceedings being initiated against a minor husband.

  • Once a husband attains majority, he becomes liable to support his legally wedded wife and minor child.

  • The Court revised the maintenance amount:

    • ₹2,500/month for the wife

    • ₹2,000/month for the child
      Total: ₹4,500/month

  • Arrears were directed to be recalculated as per the revised amount.

🔹 This case reinforces the evolving judicial approach toward equitable maintenance rights, even in situations involving underage marriages.

📌 Legal Insight:
This landmark ruling strengthens the position of dependent spouses and children under Section 125 CrPC, ensuring financial justice irrespective of the husband’s age at the time of marriage.

Real Impact. Your Legal Rights Protected. In a landmark judgment, the Bombay High Court (Nagpur Bench) reaffirmed that a woman’s right to reside in a shared household is not dependent on her actual residence in it. This crucial decision strengthens women's rights under the Protection of Women from Domestic Violence Act, 2005 , particularly under Section 17(1) . 📌 Key Takeaway from the Judgment (ABC v.
