The Court held that when a complainant—recognised as a “victim”—wants to challenge an acquittal under Section 138 of the Negotiable Instruments Act, the correct forum for filing the appeal is the Sessions Court, not the High Court.

This direction aligns with the Supreme Court’s judgment in M/s Celestium Financial vs A Gnanasekaran, where the Apex Court expanded the rights of complainants, acknowledging that they suffer direct financial loss when a cheque is dishonoured. Therefore, they are entitled to appeal under Section 372 CrPC as victims, without seeking special permission from the High Court.

Background of the Case

The ruling arose from a petition filed by Jasvir Singh, who challenged the acquittal of the accused Satpal (Vicky) in a cheque-bounce case before the Kalka trial court. Traditionally, appeals by private complainants were governed by Section 378(4) CrPC, requiring prior permission from the High Court.

However, citing the Supreme Court’s recent interpretation, Singh requested that his appeal be heard directly by the Sessions Court, ensuring a faster and more accessible remedy.

Justice Manisha Batra emphasised that just as an accused enjoys a statutory right to appeal, a victim must also have an equal opportunity to challenge acquittals—especially in private complaints where the State is not involved. The Court ordered that the matter be transferred to the Sessions Judge, Panchkula, and directed the Registry to ensure prompt transmission of the case records.
