Delhi High Court: Husband Cannot Deny Maintenance Citing Wife’s Inherited Property or Family Gifts

Landmark Ruling on Maintenance Under Domestic Violence Act

In a significant judgment strengthening women’s financial rights, the Delhi High Court has ruled that a husband cannot rely on his wife’s inherited property, stridhan, or gifts received from her parents or relatives to deny or reduce her maintenance claim.

Justice Swarana Kanta Sharma clarified that maintenance must be assessed based on the wife’s present earning capacity and the standard of living she enjoyed during the marriage, not the wealth or financial background of her natal family.

Key Observation by the Delhi High Court

“The stridhan, inherited property, or gifts received by a woman from her parents or relatives cannot be construed as a source of income so as to defeat her claim for maintenance.”

Case Background: Interim Maintenance of ₹50,000 Upheld

  • The couple married in December 2018

  • The wife filed a complaint alleging domestic abuse and financial neglect

  • She sought interim maintenance under the Protection of Women from Domestic Violence Act, 2005

  • The trial court awarded ₹50,000 per month

  • The sessions court upheld the order

  • The husband challenged it before the Delhi High Court

Husband’s Arguments Rejected by the Court

The husband claimed:

  • He was unemployed

  • The wife had sufficient financial means due to inherited properties, fixed deposits, and family gifts

  • The wife was educated and capable of earning

Court’s Findings:

  • Bank statements and income tax records showed financial transactions inconsistent with alleged unemployment

  • Lifestyle evidence contradicted claims of financial hardship

  • Educational qualification or potential earning capacity alone is not a ground to deny maintenance

  • Sale of inherited assets or isolated financial transactions do not amount to a regular source of income

Important Legal Principle on Husband’s Financial Capacity

The Court held that the husband’s financial capacity is not limited to salary or direct income alone.

It also includes:

  • Income from family business

  • Profits, dividends, or financial benefits from family enterprises

  • Any business where the husband has a share or interest

Maintenance law aims to ensure that the wife lives with dignity and reasonable comfort similar to her marital lifestyle.

Maintenance Must Match Marital Lifestyle

The Delhi High Court reiterated:

  • Maintenance should enable the wife to sustain herself in a lifestyle she was accustomed to during marriage

  • The wife’s natal family’s wealth is irrelevant

  • The husband cannot escape liability by downplaying his income

The Court concluded that ₹50,000 per month (including residential expenses) was reasonable and justified under the facts of the case.

Why This Judgment Is Important

This ruling:

  • Protects women from being denied maintenance due to family wealth

  • Strengthens the scope of maintenance under the Domestic Violence Act

  • Clarifies that stridhan and inherited assets are not “income”

  • Prevents misuse of arguments related to a woman’s education or family background
