The Jammu & Kashmir & Ladakh High Court (Rahul Bharti, J.) upheld the Trial Court’s rejection of a plaint under Order VII Rule 11 CPC, holding that the plaintiff failed to disclose a cause of action and didn’t establish any legal right or ownership over the suit property.

The Court reaffirmed that:

✔️ A plaint must clearly state facts constituting a cause of action.

✔️ Courts cannot rely on the defence version while deciding O7R11—only the plaint matters.

✔️ Rejection of plaint is a drastic power but necessary when the suit is meritless at the threshold.
