Live-In Relationship & 498A IPC: Supreme Court to Decide Scope

Supreme Court to Decide If Live-In Partner Can Be Prosecuted Under Section 498A IPC & Bharatiya Nyaya Sanhita

In a significant development with far-reaching implications for criminal and matrimonial law, the Supreme Court of India has stepped in to examine whether a man in a live-in relationship—described legally as a “relationship in the nature of marriage”—can be prosecuted for cruelty under Section 498A IPC or its equivalent provision under the Bharatiya Nyaya Sanhita (BNS).

A Bench comprising Justice Sanjay Karol and Justice Nongmeikapam Kotiswar Singh has stayed further proceedings in the matter while framing the core legal issue for authoritative determination.

🔎 Background of the Case

The matter arose from a complaint filed by a woman alleging:

  • Cruelty and physical harassment

  • Dowry demands

  • Attempt to burn her

  • Abuse during a live-in relationship

The accused, who reportedly had a subsisting marriage, approached the Karnataka High Court seeking quashing of the case, arguing that Section 498A IPC applies strictly to legally valid marriages.

However, the High Court rejected this contention and held that criminal liability for cruelty cannot be avoided merely by disputing the formal legality of the relationship if it bears the characteristics of marriage.

Aggrieved by this decision, the accused filed a Special Leave Petition before the Supreme Court of India.

⚖️ Core Legal Question Before the Supreme Court

The Supreme Court has framed the crucial issue:

Whether a man in a live-in relationship or a “relationship in the nature of marriage” can be prosecuted under Section 498A IPC or its successor provision under the Bharatiya Nyaya Sanhita?

Recognising the constitutional and social importance of the issue, the Court:

  • Issued notice to the Union of India

  • Appointed Senior Advocate Nina R. Nariman as amicus curiae

  • Stayed further criminal proceedings

  • Listed the matter for hearing in March 2026

📘 Understanding Section 498A IPC & Bharatiya Nyaya Sanhita

Section 498A IPC

Section 498A of the Indian Penal Code deals with cruelty by a husband or his relatives against a wife. It includes:

  • Physical or mental cruelty

  • Dowry harassment

  • Conduct likely to drive a woman to suicide

Bharatiya Nyaya Sanhita (BNS)

The Bharatiya Nyaya Sanhita, which replaces the IPC, contains a corresponding provision addressing cruelty in matrimonial relationships. The interpretation of this provision in the context of live-in relationships is now under judicial scrutiny.

🏛 Why This Judgment Will Be Landmark

The Supreme Court’s ruling could:

  • Expand or limit the scope of cruelty laws

  • Clarify criminal liability in live-in relationships

  • Impact domestic violence and dowry cases nationwide

  • Affect ongoing 498A quashing petitions

  • Redefine legal recognition of “relationship in the nature of marriage”

This decision will directly influence matrimonial disputes, domestic violence litigation, and criminal prosecutions across India.
