Supreme Court Dissolves Marriage Lasting Just 65 Days After 13 Years of Litigation
A Landmark Judgment on Irretrievable Breakdown of Marriage
In a significant ruling highlighting the misuse of prolonged matrimonial litigation, the Supreme Court of India dissolved a marriage that lasted only 65 days, bringing an end to a 13-year legal battle involving over 40 cases across multiple courts.
The Apex Court held that when a marriage has collapsed beyond repair, forcing parties to remain legally bound serves no purpose and only perpetuates judicial abuse.
Case Background
The couple married in January 2012, but the relationship broke down within weeks. The wife left the matrimonial home alleging cruelty, and what followed was a decade-long barrage of criminal and civil proceedings across courts in Delhi and Uttar Pradesh.
Seeking final closure, the wife approached the Supreme Court invoking Article 142 of the Constitution, requesting dissolution of marriage and termination of all related litigation — without claiming alimony.
The husband, appearing in person, opposed the plea and sought continuation of the marriage despite multiple pending cases.
Supreme Court’s Observations
A Bench comprising Justice Rajesh Bindal and Justice Manmohan ruled that:
Consent becomes irrelevant when a marriage is irretrievably broken
The bitterness between the parties made reconciliation impossible
Courts must not become arenas for personal vendettas
“They may not have been made for each other… It may be impossible now to put the clock back and live together after forgetting the bitterness.”
Final Directions by the Court
✔ Marriage dissolved using extraordinary powers under Article 142
✔ All pending cases between the parties ordered to be closed (except perjury-related matters)
✔ Future litigation between the parties restrained
✔ Costs of ₹10,000 imposed on each party for prolonging the dispute
Why This Judgment Matters
This ruling reinforces that endless matrimonial litigation causes mental, emotional, and judicial harm. It strengthens the principle of irretrievable breakdown of marriage and offers relief to parties trapped in toxic, long-standing disputes.
If you are stuck in a contested divorce, false cases, or prolonged matrimonial litigation, timely legal intervention is critical.
