Among the most striking aspects of the case was the wife's use of the term “paaltu chooha” (pet rat) to describe her husband—an insult she directed at him for refusing to separate from his aging parents. The Court held that such conduct, especially when combined with persistent pressure to abandon one’s family, constitutes mental cruelty under Indian matrimonial laws.


Court's Observation: Insulting the Husband & Undermining Joint Family Values

The Division Bench of Justice Rajani Dubey and Justice Amitendra Kishore Prasad made it clear: compelling a spouse to forsake their parents is an act of cruelty.

“This conduct cannot be considered benign; rather, it belies the claim of innocence and instead underscores mental cruelty, particularly in the context of Indian joint family values,” the Court observed.

The couple had married in 2009 and shared a child. However, by 2010, the wife had moved to her parental home, and a divorce petition was filed by the husband in 2016 on grounds of cruelty and desertion.

One of the most critical pieces of evidence was a text message from the wife:

“If you leave your parents and stay with me, respond; otherwise don’t ask.”

This message, while seemingly conditional, demonstrated her insistence that the husband choose between his family and his marriage—a demand the Court considered unreasonable and emotionally coercive.


Why the Divorce Was Upheld

The High Court reaffirmed the family court’s decision from 2019, noting that:

  • The wife had no valid justification for her prolonged stay away from the matrimonial home.

  • Witnesses and documents supported the husband’s claim of emotional abuse.

  • The wife's admissions during cross-examination further validated the husband’s account.

Furthermore, the wife’s ongoing petition for restitution of conjugal rights did not hold enough weight to overturn the well-documented evidence of cruelty and desertion.

Alimony Granted

Despite upholding the divorce, the Court took into account the financial responsibilities of both parties. The wife was awarded ₹5 lakh as permanent alimony, considering her role in raising their child and the husband’s employment as an accountant with the District Cooperative Bank in Raipur.
