Telangana High Court: Working Wife’s Schedule Not Mental Cruelty – Divorce Appeal Rejected
“Normal wear and tear of married life is not cruelty” – Telangana High Court
In a significant judgment, the Telangana High Court has reaffirmed that ordinary matrimonial disputes, work schedules of a wife, or family interference do not amount to mental cruelty under matrimonial law.
A Division Bench of Justices Moushumi Bhattacharya and Nagesh Bheemapaka dismissed an appeal filed by a husband challenging the Family Court’s refusal to grant divorce on grounds of mental cruelty.
Key Observations by the Court
The High Court relied on settled Supreme Court precedents and observed:
“Mere trivial irritations, quarrels, and normal wear and tear of married life, which happen in day-to-day life, would not be adequate for grant of divorce on the ground of mental cruelty.”
Case Background
Marriage solemnised in May 2015
Couple living separately since October 2018
Divorce petition filed in 2019
Husband alleged:
Wife failed to manage household duties
Wife frequently stayed at her parental home
Pressure to live separately from parents
Filing of Section 498A IPC case by wife’s father leading to arrest and job loss
Court’s Findings
The Court held that:
✔ A working wife balancing professional and matrimonial responsibilities cannot be accused of cruelty
✔ Filing of legal complaints alone does not establish mental cruelty
✔ Medical complications, including pregnancy-related issues, cannot be used to blame the spouse
✔ Allegations were not supported by evidence of persistent ill conduct
The appeal was therefore dismissed, and the Family Court’s order upheld.
Legal Insight: Mental Cruelty Must Be Proved
This judgment reiterates an important principle under Hindu Marriage Act, 1955:
👉 Mental cruelty must be serious, continuous, and proven by evidence
👉 Normal marital disagreements are not sufficient grounds for divorce
If you are considering filing or defending a contested divorce case, proper legal guidance is crucial.
