Telangana High Court: Working Wife’s Schedule Not Mental Cruelty – Divorce Appeal Rejected

“Normal wear and tear of married life is not cruelty” – Telangana High Court

In a significant judgment, the Telangana High Court has reaffirmed that ordinary matrimonial disputes, work schedules of a wife, or family interference do not amount to mental cruelty under matrimonial law.

Division Bench of Justices Moushumi Bhattacharya and Nagesh Bheemapaka dismissed an appeal filed by a husband challenging the Family Court’s refusal to grant divorce on grounds of mental cruelty.

“Mere trivial irritations, quarrels, and normal wear and tear of married life, which happen in day-to-day life, would not be adequate for grant of divorce on the ground of mental cruelty.”
